Amanda Barkin is an associate in the Litigation Group focusing on intellectual property and speech.
Amanda's practice focuses on content and speech for a variety of clients including YouTube channels, podcasts, production studios, journalists, video game developers, advertising agencies, and art collectors.
Amanda manages a fan-art licensing program for a New York Times best-selling author; reviews pre-publication content assessments for defamation, right of privacy, and intellectual property liability; negotiates and drafts licensing agreements, independent contractor agreements, and employment agreements; and drafts and responds to cease and desist letters and DMCA takedown notices.
Defending leading audio engineers in a trademark, false advertising, and defamation case brought by a competitor;
Litigating trademark claims on behalf of an emerging tequila brand;
Litigating fraud claims on behalf of an art collector;
Defending a healthcare company in a trademark and false advertising case brought by a competitor; and
Litigating false advertising claims on behalf of a manufacturing client.
Prior to joining Frankfurt Kurnit, Amanda served as a judicial law clerk to the Honorable Colleen McMahon, United States District Judge for the Southern District of New York. She previously worked as a litigation associate at Schulte Roth & Zabel, LLP. Amanda is admitted to the United States District Courts for the Southern, Eastern, and Northern Districts of New York.
